SkyPower seeks $100 million from Ontario for "unlawful" changes to FIT program |
16.07.2012: Canadian solar project developer SkyPower Corp. is asking the Ontario Superior Court of Justice to reverse retroactive changes made to Ontario’s feed-in-tariff (FIT) program last spring. In an application for judicial review filed with the court, law firms representing 118 SkyPower solar projects allege that changes to the FIT program called for by the minister of energy and implemented by the Ontario Power Authority (OPA) are unlawful because they retroactively affect applications for FIT contracts that had been filed under the old rules. The application asks the court to order OPA to “process in good faith” applications to the FIT program that were submitted before April 5, 2012 in accordance with the FIT rules that were in place when those applications were filed. According to SkyPower, the new FIT rules “are unfair, would wipe out most of the projects in the application queue, and would make it virtually impossible to build or finance any new ground-mounted solar capacity in Ontario.” A hearing has been set for July 24, at which time the government and OPA may respond.
